Evernote resets passwords after data breach

Evernote, a Web-based note-sharing service, said it was resetting the passwords of its 50 million users because hackers managed to breach its computer network and access some user names, email addresses and encrypted passwords.

Evernote spokeswoman Ronda Scott said via email on Saturday that the attack "follows a similar pattern" to other cyber attacks on Internet-based companies in recent weeks, but she did not elaborate.

"In our security investigation, we have found no evidence that any of the content you store in Evernote was accessed, changed or lost," the company said on its website. "We also have no evidence that any payment information for Evernote Premium or Evernote Business customers was accessed."

Scott declined to say how many accounts had been exposed or whether it might be possible for the hackers to unscramble encrypted passwords.

A series of technology companies including Facebook, Apple, Microsoft and Twitter have recently disclosed cyber attacks. In the majority of those cases, the companies said that the unknown hackers exploited a bug in Java software and that no user information was compromised.

Twitter is the only major Internet company that has recently reported its user information was exposed to hackers. On Feb. 1, Twitter reset passwords for 250,000 accounts whose encrypted passwords may have been accessed.

Scott said Evernote believed that the hackers did not exploit a bug in Java when they broke into the company's system.

Evernote is a privately held company whose major investors include Meritech Capital, CBC Capital, Sequoia Capital, Morgenthaler Ventures and DOCOMO Capital.

Governor denies parole to ex-Manson follower

(AP) ? The enduring mystery of why young people joined Charles Manson's murderous family appeared to be at the heart of Gov. Jerry Brown's decision Friday to reverse a parole board's recommendation and keep Bruce Davis in prison.

Brown said he wants Davis, who has been behind bars for 42 years, to come clean about all the details of his involvement with Manson's cult and the two gruesome killings of a stuntman and a musician.

It was the second time in less than three years that a California governor has rejected a parole board ruling in Davis' case. Gov. Arnold Schwarzenegger refused his release in 2010, citing the heinous nature of Davis' crimes and his efforts to minimize his involvement.

Brown repeated those reasons in a six-page decision but added his belief that Davis still has more to disclose about the killings.

"Until Davis can acknowledge and explain why he actively championed the Family's interests and shed more light on the nature of his involvement, I am not prepared to release him," Brown said.

"After 42 years of incarceration, it is encouraging that Davis is beginning to reveal the actual details of what happened. But it is clear that he continues to withhold information about these events," Brown said.

The state parole board, citing the prisoner's positive progress, approved release of the 70-year-old Davis, but the Democratic governor had the last word.

Brown gave his decision to The Associated Press at the downtown Los Angeles County courthouse after a meeting with District Attorney Jackie Lacey, who had recommended that Davis not be paroled.

Davis' attorney, Michael Beckman, called the governor's decision "horrible" and contrary to the findings of parole commissioners who conducted hearings for Davis and found him eminently suitable for parole. He said Davis has told everything he knows.

"I have represented over 700 life prisoners and of all of them, Bruce Davis is the most rehabilitated and qualified," the attorney said.

He said Brown's "paper review" of the case was insufficient to understand who Davis is today.

Brown said, "I find the evidence ... shows why he currently poses a danger to society if released from prison. Therefore, I reverse the decision to parole Mr. Davis."

But Beckman said that the governor failed to articulate any reason why Davis might pose a danger now.

If the problem is association with the Manson family, Beckman said, "They should pass a law saying if you were involved with these people you can't get out. But there is no such law. "

Brown's decision focused on Davis' role in the murderous Manson Family in the late 1960s.

"The record indicates that Davis fully embraced and championed the family's distorted values and goals, and was willing to protect the family's interests at all costs," the decision said.

Davis would have been only the second Manson-related murder defendant to be granted parole since the killing spree began in 1969.

Davis was not involved in the notorious Sharon Tate-LaBianca killings but was convicted with Manson and others in the murders of musician Gary Hinman and stuntman ranch hand Donald "Shorty" Shea.

Manson was a direct participant in both killings, according to witnesses.

Steve Grogan, another participant in those murders, was released in 1985 after he led police to where the bodies were buried in the San Fernando Valley.

Beckman noted that Grogan, a central figure in the killings, has lived as an upstanding citizen for 27 years with no problems since his release.

Davis was 30 when he was sentenced to life in prison in 1972 in the case, which was a postscript to Manson's notorious reign as leader of the murderous communal cult.

Davis long maintained that he was a bystander in the killing of the two men. But in recent years, he has acknowledged his shared responsibility. He said his presence may have emboldened others to take action because he was an elder of the group.

Brown said Davis' refusal to fully acknowledge his responsibility for the killings was central to his decision.

"I do not believe that Davis was just a reluctant follower who passively went along with the violence," he said. "Davis was older, more experienced, he knew what the Manson Family was capable of, and he knowingly and willingly took part in these crimes."

Davis became a born-again Christian in prison and ministered to other inmates, married a woman he met through the prison ministry, and has a grown daughter. The couple recently divorced.

Davis also earned a master's degree and a doctorate in philosophy of religion.

Brown commended him for his self-help efforts but said the work was outweighed by other factors.

Manson and three of his followers, Leslie Van Houten, Patricia Krenwinkel and Charles "Tex" Watson, remain in prison for life in the Tate killings. Their co-defendant, Susan Atkins, died of cancer behind bars in 2009.

(AP) ? Best Buy Co. lost less money in the fourth quarter as efforts by new CEO Hubert Joly to make the company more efficient showed glimmers of paying off.

The struggling electronics chain also said Friday that it did not receive a buyout bid from its co-founder Richard Schulze by the deadline Thursday, ending one question mark that had been hovering over the Minneapolis company.

The retailer's fourth-quarter results beat expectations, but Best Buy gave a cautious outlook on the first quarter because it is ramping up investments and the timing of some sales has changed from last year.

Best Buy has been working to turn around results as it faces tough competition from online retailers and discounters. The company has cut jobs, invested in training employees and started matching online prices. Results show that the changes are beginning to help.

U.S. revenue in stores open at least 14 months rose 0.9 percent, the best performance in 11 quarters, Joly pointed out in an interview with the AP.

"We have momentum building. We're at the beginning of a transformation taking hold," Joly said.

Results may give investors more faith in new management, including Joly, who joined the company in August, and CFO Sharon McCollam, who joined in December, said NBG Productions analyst Brian Sozzi.

He said Best Buy is showing "striking positives," including better-than-expected gross margin ? the percentage of each dollar in revenue a company actually keeps ? and an 11.2 percent increase in U.S. online sales.

"Every transaction online was essentially the equivalent of convincing groups of previously disenchanted customers that yes, Best Buy is finally price competitive," Sozzi said.

Earlier this week Minneapolis-based Best Buy announced 400 job cuts at its headquarters as part of a $725 million cost-cutting plan. On Friday the company said it expects to announce more job cuts later this year.

The company also said it plans $700 million to $800 million in capital spending and $150 million to $200 million in other expenses in fiscal 2014 as it invests in its business, mainly online and mobile channels. It plans to revamp Bestbuy.com by fiscal 2015.

"2014 is a year of transition," Joly said in a call with investors. "Further investment will be required to advance our 'Renew Blue' transformation"

Its loss after paying preferred dividends for the three months ended Feb. 2 totaled $409 million, or $1.21 per share, for the three months ended Feb. 2. That compares with a loss of $1.82 billion, or $5.17 per share, a year earlier.

Excluding restructuring and other costs, adjusted earnings came to $1.64 per share. Analysts expected $1.54 per share, according to FactSet.

Revenue was nearly flat at $16.71 billion, from $16.67 billion last year. Analysts expected $16.29 billion.

U.S. revenue in stores open at least 14 months rose 0.9 percent, helped by performance from Best Buy's standalone mobile stores. International revenue in stores open at least a year fell 6.6 percent due to weak results in Canada and China.

Best Buy also absorbed restructuring charges of $203 million related to closing stores and severance. It took an $822 million impairment charge to write off worse than expected results in Canada and China as well as $44 million in asset impairments.

"Renewed momentum in the domestic business more than offset continued softness in the International business," Joly said.

For the year, the loss totaled $249 million, or 73 cents per share. That compares with a loss of $1.32 billion, or $3.57 per share, the year before. Revenue edged down less than 1 percent to $49.62 billion from $50.04 billion.

CFO Sharon McCollam said she expects first-quarter results to be "under significant pressure" because there will be a week less of sales compared with last year. Also, people buying TVs before the Super Bowl helped the company in the fourth quarter this year, compared with the first quarter last year. That helped net income by 14 cents per share in the fourth quarter.

The company is also making investments during the quarter in a price-matching program and revamping its websites.

Schulze, who founded the company in 1966 and is its largest shareholder by far with a 20 percent stake, had been considering a bid or selling his stake since resigning in June. That followed an investigation that led to the resignation of CEO Brian Dunn due to an inappropriate relationship with a female staffer.

Schulze had until Feb. 28 to make an offer for the company, but no offer materialized, Best Buy said Friday.

In a filing with the SEC on Friday, Schulze said he was in negotiations with Best Buy about deal in which up to three private equity firms would invest in the company, in exchange for a board seat for each firm plus two nominees by Schulze. But Best Buy turned down the offer. Schulze is still deciding whether he will exercise his right to appoint two nominees to Best Buy's board.

Shares rose 15 cents to $16.56 in afternoon trading. The stock has traded between $11.20 and $27.95 over the past 52 weeks.

Penney's shares plunge after 4Q massive loss

(AP) ? Shares of J.C. Penney Co. plunged a day after the department-store chain reported massive losses and a nearly 30 percent drop in revenue in its fiscal fourth-quarter period.

The results, which were much worse than Wall Street expected, cap off a full year of steep losses and sales drops since CEO Ron Johnson launched a turnaround plan that included getting rid of most the 600 or so discounts the chain used to offer each year in in favor of everyday low prices.

Penney reported on Wednesday after the markets closed that it widened its quarterly loss to $552 million, or $2.51 per share. Revenue fell 24.8 percent to $12.98 billion.

On Thursday, its shares fell 19 percent, or $3.98, to $17.18. Shares have dropped 60 percent since early last year.

McIlroy walks off course at Honda Classic

PALM BEACH GARDENS, Fla. (AP) ? Rory McIlroy abruptly walked off the course Friday at the Honda Classic and left everyone wondering what was wrong with golf's No. 1 player.

McIlroy already was 7-over par through eight holes of the second round when he hit his second shot into the water on the par-5 18th at PGA National. He shook hands with Ernie Els and Mark Wilson and was headed to the parking lot before they even finished the hole.

"There's not really much I can say, guys," McIlroy told three reporters who followed him to his car. "I'm not in a good place mentally, you know?"

He said there was nothing wrong physically. When asked about his swing, the 23-year-old from Northern Ireland replied, "Yeah, I really don't know what's going on."

About an hour after he left, McIlroy released a statement that attributed his withdrawal to a sore wisdom tooth.

"I have been suffering with a sore wisdom tooth, which is due to come out in the near future," McIlroy said. "It began bothering me again last night, so I relieved it with Advil. It was very painful again this morning, and I was simply unable to concentrate. It was really bothering me and had begun to affect my playing partners."

McIlroy apologized to the tournament, saying he had every intention of defending his title at the Honda Classic.

If his golf wasn't shocking enough, the manner in which he left raised plenty of questions about the state of game ? and his head ? in the month leading to the Masters.

McIlroy, coming off a year in which he won a second major in record fashion, already set himself up for scrutiny when he left Titleist to sign an equipment deal with Nike that was said to be worth upward of $20 million a year.

Nike introduced him with blaring music and a laser show in Abu Dhabi, but it's been all downhill from there.

McIlroy missed the cut in the Abu Dhabi Golf Championship with rounds of 75-75. He took a four-week break, and then was eliminated in the opening round of the Match Play Championship to Shane Lowry in one of the most poorly played matches of the round.

McIlroy played 36 holes with Tiger Woods at The Medalist on Sunday and said Tuesday it was no time to panic.

"Even though my results haven't revealed it, I really felt like I was rounding a corner," McIlroy said. "This is one of my favorite tournaments of the year and I regret having to make the decision to withdraw, but it was one I had to make."

It looked more like McIlroy was sinking than rounding the corner, not difficult to do on a course with so many water hazards. And he found plenty of them.

McIlroy, who opened with a 70, hit two poor chips that led to double bogey on No. 11, and a wild tee shot to the right led to a bogey on the 13th. His round really unraveled on the par-4 16th, when he hit his tee shot to the right and into the water, took a penalty drop, and then came up short of the green and into the water again. He made a 6-foot putt for a triple bogey.

He three-putted from 40 feet, running his first putt about 10 feet by the hole, for a bogey to go 7 over. And then came the approach that found water for the third time of his short day on the 18th.

McIlroy is scheduled to play next week in the Cadillac Championship at Doral, which has no cut, and then the Houston Open. But on the first day of March, he has completed only four rounds of competition.

It was the second straight year one of golf's biggest stars failed to finish a tournament on the Florida swing. Woods withdrew after 11 holes on the final round at Doral last year because of tightness in his Achilles tendon, raising questions about the seriousness of his recurring leg injuries. He won Bay Hill two weeks later.

McIlroy at least drove off from PGA National without a helicopter camera following him.
