US swipes at China for hacking allegations

WASHINGTON (AP) ? The U.S. has taken its first real swipe at China following accusations that the Beijing government is behind a widespread and systemic hacking campaign targeting U.S. businesses.

Buried in a spending bill signed by President Barack Obama on Tuesday is a provision that effectively bars much of the federal government from buying information technology made by companies linked to the Chinese government.

It's unclear what impact the legislation will have, or whether it will turn out to be a symbolic gesture. The provision only affects certain non-defense government agency budgets between now and Sept. 30, when the fiscal year ends. It also allows for exceptions if an agency head determines that buying the technology is "in the national interest of the United States."

Still, the rule could upset U.S. allies whose businesses rely on Chinese manufacturers for parts and pave the way for broader, more permanent changes in how the U.S. government buys technology.

"This is a change of direction," said Stewart Baker, a former senior official at the Homeland Security Department now with the legal firm Steptoe and Johnson in Washington. "My guess is we're going to keep going in this direction for a while."

Rep. Dutch Ruppersberger of Maryland, the top Democrat on the House Intelligence Committee, said he supports the restriction and doesn't think it would be too cumbersome for federal agencies. The Defense and Energy departments already are mindful of how its networks are built.

"Anything we can do to call awareness to the fact that we're continuing to be cyberattacked, we're continuing to lose jobs, and that billions of dollars in American money is being stolen," Ruppersberger said in an interview Wednesday.

In March, the U.S. computer security firm Mandiant released details on what it said was an aggressive hacking campaign on American businesses by a Chinese military unit. Since then, Treasury Secretary Jacob Lew has used high-level meetings with Beijing officials to press the matter. Beijing has denied the allegations.

Congressional leaders have promised to push comprehensive legislation that would make it easier for industry to share threat data with the government. But those efforts have been bogged down amid concerns that too much of U.S. citizens' private information could end up in the hands of the federal government.

As Congress and privacy advocates debate a way ahead, lawmakers tucked "section 516" into the latest budget resolution, which enables the government to pay for day-to day operations for the rest of the fiscal year. The provision specifically prohibits the Commerce and Justice departments, NASA and the National Science Foundation from buying an information technology system that is "produced, manufactured or assembled" by any entity that is "owned, operated or subsidized" by the People's Republic of China.

The agencies can only acquire the technology if, in consulting with the FBI, they determine that there is no risk of "cyberespionage or sabotage associated with the acquisition of the system," according to the legislation.

The move might sound like a no-brainer. If U.S. industry and intelligence officials are right, and China is stealing America's corporate secrets at a breathtaking pace, why reward Beijing with lucrative U.S. contracts? Furthermore, why install technical equipment that could potentially give China a secret backdoor into federal systems?

Last fall, Ruppersberger and House Intelligence Committee Chairman Mike Rogers, R-Mich., released a report urging U.S. companies and government agencies to drop any business with Chinese telecommunications companies Huawei Technologies Ltd. and ZTE Corp. because of the security risks they pose.

"Any bug, beacon or backdoor put into our critical systems could allow for a catastrophic and devastating domino effect of failures throughout our networks," Rogers said in a statement accompanying the report.

But a blanket prohibition on technology linked to the Chinese government may be easier said than done. Information systems are often a complicated assembly of parts manufactured by different companies around the globe. And investigating where each part came from, and if that part is made by a company that could have ties to the Chinese government could be difficult.

Huawei, the third-largest maker of smartphones, says it is owned by its employees and rejects claims that it is controlled by the communist government or China's military.

Depending on how the Obama administration interprets the law, Baker said it also could cause problems for the U.S. with the World Trade Organization, whose members include U.S. allies like Germany and Britain that might rely on Chinese technology to build computers or handsets.

But in the end, Baker says it could make the U.S. government safer and wiser.

"We do have to worry about buying equipment from companies that may not have our best interests at heart," he said.

Stewart asks the court to find there are no marital assets to divide. He says Williams is "an able-bodied person, earning income, and is capable of supporting herself." He asks that neither side be ordered to pay alimony.

Stewart was a sensation in Pittsburgh in the late 1990s and was nicknamed "Slash" for his versatility as quarterback, running back and wide receiver.

A Narrow Escape, and Lasting Guilt - NYTimes.com

I was a new mom at 36, and there was a lot about motherhood that terrified me. I had no experience with infants, nor did my husband,? Michael. As happy as we were to be expecting, I was filled with fear and trepidation. How on earth would I know what to do?

So it was revelatory to discover that holding my new daughter, Gillian, was like being home.

In my arms her soft, solid warmth still felt a part of me, part of my body. Over the first few weeks the power of my love grew such that nothing could? ever pry her out of my arms. I know this. I knew it once, anyway.

On the morning after Thanksgiving, 1998, Gillian and I were alone in the quiet house. She woke early as 10-week-olds do and smiled as I entered the room.

After our blissful morning cuddle, off we went, toward the stairs, ready to take on the day. Gillian was cooing in my arms and I was thinking about the leftovers and festive clutter needing my attention down in the kitchen.

And just at the top of the stairs ? an overconfident step, slightly off balance, a moment?s distraction. My feet went flying, my hands grasping for the handrails in frantic reflex and instantly, shockingly, Gillian?s soft weight left my hold.

My vision was filled with her face, contorted in surprise but no fear ? she didn?t yet know fear ? floating down the stairway in front of me.

I had slipped at the very top of the stairs, a 14-step flight. As she flew down she looked up at me, her mouth an ?O? and her eyebrows as far up as they could go, all the long way down. As I crashed down the stairs myself, clumsily and painfully, unfathomable thoughts crashed through my brain.

How? How could I ever have let go?

Our child would never grow up, Michael would never forgive me, the pain would be eternal.

I?d wrecked our family forever.

And then she landed. Feet first, face down, her tummy hit the edge of the bottom step as her head clocked the wall, right at the sharp edge of the wooden molding. I frantically finished my own descent, holding my breath and hearing only silence.

And then she cried. Somehow I managed to call 911 and somehow I got Gillian, still wailing, into her bucket-shaped car seat and made my way to the street. The ambulance finally came to take us away.

The questions began immediately. What happened? they asked. Is this your first child? Does she cry a lot? How are you feeling? Have you been sleeping well? Have you been sad?

I understood what they were looking for, but it felt appropriate to be judged and found wanting. Clearly, I thought, I?m unfit for this job. It?s wrong to trust me to take care of my own baby.

Gillian was fine. And forgetful, and forgiving. I wasn?t. Michael carpeted the stair steps and covered me with love and unstinting support. He never wavers from his affirmation that, yes, accidents happen and, yes, this was indeed an accident.

I was not so easily convinced.

The shame of having dropped my baby was ? is ? palpable. You what? You dropped your baby down the stairs? Other mothers can?t fathom such a thing. Of course not. Neither could I, before it happened to me.

We so often hear of tragedy ? a hot car, an unlocked pool gate, the limits of a rear-view mirror ? caused by devoted parents or caregivers. I?m more sympathetic because I think I understand a little bit of the dark shape of a life burdened with guilt beyond repair.

For those brief moments, as my daughter flew dangerously down a long, long flight of stairs, I was there, thinking I had killed my child. And I will never forget.

The Christmas pictures from that year show my wrist brace from my own injury, clear evidence of my carelessness. I walk down those stairs every day and shudder a little, and thank providence once again that we were lucky.

It took a long time but I eventually started to trust myself to keep my baby safe. Our second baby was born two years later, and we managed to get her through her toddler years unscathed. Yet I never felt fully relieved of the guilt until Gillian herself could understand the story and forgive me, and promise me she doesn?t remember a thing.

I do.

Deleting your online presence - share your experiences | News ...

The internet helps to connect people around the world, but what happens when you want to disconnect? Photograph: Graham Turner for the Guardian

A growing number of people are claiming "the right to be forgotten" online - but removing your online profile from the internet isn't always easy as you'd think.

Charles Arthur, editor of Guardian technology, says: "You shouldn't put anything online you don't want to be visible to everyone forever. You can try to get stuff removed ? and you might be lucky enough to succeed ? but all someone has to do when they see a photo or web page is to copy the image or do a screenshot of the page, and that's your deletion efforts wasted."

The Guardian is investigating online profiles and deletion processes and we want to hear from those who have experience in trying to disappear from the web. Do you think sensitive personal data about yourself is too readily available online? Have you tried to delete your social media activity that is no longer relevant? Or have you tried to have press coverage about yourself erased?

Share your experiences with us anonymously by filling in the form below. You can also contact our news team directly by emailing mark.rice-oxley@guardian.co.uk or owen.bowcott@guardian.co.uk.

Central African Republic suspended from African Union, says official

ADDIS ABABA (Reuters) - The African Union has suspended the Central African Republic after rebels seized power in the country and has imposed travel bans and asset freezes on insurgent leaders, a senior AU official said on Monday.

The power grab by the Seleka rebel coalition, the latest in a series of coups and rebellions since the mineral-rich nation won independence from France in 1960, has already been condemned by the African Union and United Nations.

"The (Peace and Security) Council has decided to suspend with immediate effect the Central African Republic from all the African Union's activities," the AU's Commissioner for Peace and Security, Ramtane Lamamra, told reporters in Addis Ababa, where the African organization is based.

The United States, France and regional powerbroker Chad have called on Seleka leader Michel Djotodia to respect a January power-sharing deal signed in the Gabonese capital Libreville. A rebel leader has pledged to name a power-sharing government.

The Libreville agreement had created a government drawn from rebel leaders, the civilian opposition and loyalists of former president Francois Bozize. It was led by Prime Minister Nicolas Tiangaye, a former lawyer and member of the civilian opposition.

Seleka, a loose coalition of five rebel groups whose name means 'alliance' in the Songo language, had accused Bozize of breaking the January agreement by failing to integrate their fighters into the army.

Asian shares, euro spooked by Cyprus bailout details

By Chikako Mogi

TOKYO (Reuters) - Asian shares eased and the euro wobbled on Tuesday as investors worried about potential risks from the Cyprus bailout scheme, after initial rallies on the last-minute rescue provided opportunities to book some profit.

"The market had been positioned for a good result on Cyprus, they got it and now there's profit taking," said Ric Spooner, chief market analyst at CMC Markets.

"Bearing in mind that a crisis has been averted, the overall situation is just a reminder of the risk involved in Europe. The rescue process was fraught with politics and a risk that it would fall over, and people were contemplating that this morning," he said.

Japan's Nikkei stock average <.n225> trimmed some of its earlier losses and was down 0.2 percent by late morning, after closing up 1.7 percent and inching closer to a 4-1/2-year high the day before. <.t/>

The MSCI's broadest index of Asia-Pacific shares outside Japan <.miapj0000pus> eased 0.3 percent after gaining more than 1 percent on Monday after the Cyprus deal. The materials sector <.miapjmt00pus> led the declines with a 1 percent drop.

Australian shares <.axjo> fell 0.7 percent as investors sold miners and financials in response to weaker metal prices and new worries about the euro zone, while Shanghai shares <.ssec> slid 1.9 percent and Hong Kong stocks <.hsi> fell 0.6 percent.

China shares were headed for their worst loss in three weeks, with brokerages hit by fears of more fund raising in the sector, while mid-sized banks were sold on worries about tighter mortgage lending restrictions.

South Korean shares <.ks11> bucked the downtrend with a 0.2 percent gain and Southeast Asian bourses also defied the generally cautious mood and advanced.

Revived pressure on the euro helped lift the dollar index <.dxy>, measured against a basket of major currencies, towards a 7-1/2-month peak of 83.166 set earlier this month.

The euro was at $1.2867, after sliding more than 1 percent against the dollar and hitting a four-month low of $1.28295 on Monday. The single currency closed below its 200-day moving average of around $1.2880 on Monday for the first time since November.

Traders said the euro could be supported by short-covering and repatriation before the end of the first quarter, but renewed concerns about the health of euro zone's financial system would likely set a ceiling at $1.30. The euro hit a session high of $1.3050 on Monday.

Against the yen, the dollar was up 0.2 percent to 94.30, having touched a low of 93.53 yen on Monday, barely above a recent low of 93.45 seen earlier this month.

CYPRUS FALLOUT

Large, uninsured depositors and bondholders will bear heavy losses in the Cyprus bailout, which Dutch Finance Minister Jeroen Dijsselbloem, who heads the Eurogroup of euro zone finance ministers, said represented a new template for euro zone and other countries which may have to restructure their banking sectors.

Initial rallies in global equities and the euro fizzled after his remarks, as they raised the prospect of shifting more risk to depositors and stakeholders in future.

While the bailout will avert collapse of the Cypriot banking system and keep Cyprus within the euro zone, the agreement may have set a painful precedent for the region.

"The design of the plan is setting market sentiment. Attention is put into the details and any actual contagion risk out of that plan, so overall sentiment is a little bit subdued, but not collapsing," said Frances Cheung, senior strategist at Credit Agricole CIB in Hong Kong.

Better U.S. data pointing to a continued recovery in the world's largest economy provided some comfort to the market, and with investors are growing accustomed to Europeans scrambling to find a last-minute solution to avert a crisis, sentiment will not sour drastically as long as there is no collapse in the euro zone economy, she added.

After reaching an 11th-hour deal with the European Union, the European Central Bank and the International Monetary Fund to shut down the country's second largest bank in return for 10 billion euros ($13 billion) in rescue funds, the president of Cyprus assured citizens the bailout deal was in their best interests. But banks will remain closed until Thursday and even then subject to capital controls to prevent a run on deposits.

BOJ'S KURODA SPEAKS

Bank of Japan chief Haruhiko Kuroda, who took over as the head of the Japanese central bank last week, said buying longer-dated debt was a policy option to pursue monetary easing.

His comments sent benchmark 10-year Japanese government bond yields down as low as 0.525 percent, its lowest level since June 2003. The 10-year yield has hit the near-decade low for a fourth straight day.

London copper was barely changed at $7,617.50 a metric ton while spot gold eased 0.2 percent, holding barely above $1,600 an ounce.

U.S. crude futures inched down 0.1 percent to $94.73 a barrel and Brent also eased 0.1 percent to $108.07.

Powerball: 1 winner in NJ drawn for $338M jackpot

DES MOINES, Iowa (AP) ? Powerball and the New Jersey Lottery say on their online sites that one winning ticket was sold in New Jersey for Saturday night's $338.3 million Powerball jackpot.

Neither agency provided details of exactly when or where the winning ticket was sold in announcing on their websites that one ticket was sold for winning numbers: 17, 29, 31, 52, 53 and Powerball 31.

Powerball's website said that as of Sunday, the current estimated jackpot was $40 million, or a $25 million cash value. Telephone messages left with the New Jersey Lottery by The Associated Press seeking more details about the ticket were not immediately returned.

In this Tuesday, March 19, 2013 photo, the board at the Metropolitan Museum of Art in New York displays admission fees, which are recommended but not mandatory. Many visitors to the museum, especially foreign tourists, don?t realize that the fees listed on the sign are merely suggestions. Confusion over what?s required to enter the Met, which draws more than 6 million visitors a year, is at the heart of a class-action lawsuit this month accusing it of an illegal ?scheme? to defraud the public into believing the fees are required. (AP Photo/Mary Altaffer)

NEW YORK (AP) ? Before visitors to the Metropolitan Museum of Art can stroll past the Picassos, Renoirs, Rembrandts and other priceless works, they must first deal with the ticket line, the posted $25 adult admission and the meaning of the word in smaller type just beneath it: "recommended."

Many people, especially foreign tourists, either don't see it, don't understand it or don't question it. If they ask, they are told the fee is merely a suggested donation: You can pay what you wish but you must pay something.

Some who choose to pay less than the full price pull out a $10 or $5 bill. Some fork over a buck or loose change. Those who balk at paying anything at all are told they won't be allowed in unless they pay something, even a penny.

"I just asked for one adult general admissions and he just said, '$25,'" says Richard Johns, a high school math teacher from Little Rock, Ark., who paid the full price at the museum this past week. "It should be made clear that it is a donation you are required to make. Especially for foreign tourists who don't understand. Most people don't know it."

Confusion over what's required to enter one of the world's great museums, which draws more than 6 million visitors a year, is at the heart of a class-action lawsuit this month accusing the Met of scheming to defraud the public into believing the fees are required.

The lawsuit contends that the museum uses misleading marketing and training of cashiers to violate an 1893 New York state law that mandates the public should be admitted for free at least five days and two evenings per week. In exchange, the museum gets annual grants from the city and free rent for its building and land along pricey Fifth Avenue in Central Park.

Met spokesman Harold Holzer denied any deception and said a policy of requiring visitors to pay at least something has been in place for more than four decades. "We are confident that the courts will see through this insupportable nuisance lawsuit."

The suit seeks compensation for museum members and visitors who paid by credit card over the past few years.

"The museum was designed to be open to everyone, without regard to their financial circumstances," said Arnold Weiss, one of two attorneys who filed the lawsuit on behalf of three museum-goers, a New Yorker and two tourists from the Czech Republic. "But instead, the museum has been converted into an elite tourist attraction."

Among the allegations are that third-party websites do not mention the recommended fee, and that the museum sells memberships that carry the benefit of free admission, even though the public is already entitled to free admission.

Lined up to testify is a former museum supervisor who oversaw and trained the Met's admissions cashiers from 2007 to 2011. Michael Hiller, the other attorney representing the plaintiffs, said the supervisor trained cashiers to encourage visitors to pay the full freight by saying things like "you must realize it is very expensive to run the museum." He will also say that in 2010-2011 the term on the sign was changed from "suggested" to "recommended" because administrators believed it was a stronger word that would encourage people to pay more.

The Met's Holzer denied the former employee's allegations. He also said the basis for the lawsuit ? that admission is intended to be free ? is wrong because the state law the plaintiffs cited has been superseded many times and the city approved pay-what-you-wish admissions in 1970.

"The idea that the museum is free to everyone who doesn't wish to pay has not been in force for nearly 40 years," Holzer said, adding, "Yes, you do have to pay something."

As to the wording change on the sign, he said the museum "actually thought at the time, and still thinks, that 'recommended' is softer than 'suggested,' so the former employee is quite wrong here."

New York City's Department of Cultural Affairs agreed to the museum's request in 1970 for a general admission as long as the amount was left up to individuals and that the signage reflected that. Similar arrangements are in place for other cultural institutions that operate on city-owned land and property and receive support from the city, such as the American Museum of Natural History and the Brooklyn Museum. It's also a model that's been replicated in other cities.

The Metropolitan Museum is one of the world's richest cultural institutions, with a $2.58 billion investment portfolio, and isn't reliant on admissions fees to pay the majority of its bills. Only about 11 percent of the museum's operating expenses were covered by admissions charges in the 2012 fiscal year. As a nonprofit organization, the museum pays no income taxes.

Holzer also noted that in the past fiscal year, 41 percent of visitors to the Met paid the full recommended admission price ? $25 for adults, $17 for seniors and $12 for students.

A random sampling of visitors leaving the museum found that there was a general awareness that "recommended" implied you could pay less than the posted price.

But Dan Larson and his son Jake, visiting the museum last week from Duluth, Minn., were unaware there was any room to negotiate the admission price. They paid the full $25 each for adult tickets.

"My understanding was you pay the recommended price," said Larson, 50. "That's clearly not displayed."

Alexander Kulessa, a 23-year-old university student from Germany, said friends who had previously visited New York tipped him off about the admission fee.

"They said, 'Don't pay $25,'" said Kulessa. "They said it will be written everywhere to pay $25 but you don't have to pay that. You don't even have to pay the student price."

For Colette Leger, a tourist from Toronto who visited the museum with her teenage daughter, paying the full $25 was worth every penny.

"It's a beautiful museum and I was happy to pay," she said.

trent-richardson-getty-tGetty Images

The bad news for Browns running back Trent Richardson this week is that he can no longer use the top of his helmet to ram opponents.? The worse news is that he now faces civil charges of assaulting a pair of women last December.

The only good news is that he?s not accused of ramming them with the top of his helmet.

According to the Cleveland Plain Dealer, Krystal Jones and Kathleen Hunter filed a lawsuit on Friday, claiming that Richardson, his girlfriend, and his brother, Terrell, verbally and physically assaulted the duo at Richardson?s home.

The incident occurred after the Browns? December 9 win over the Chiefs.? A celebration at Richardson?s house lasted into the morning hours of Monday, December 10, with Richardson?s girlfriend, Sevina Fatu, inviting Jones and Hunter to attend.

The women claim that Richardson at one point asked them to leave and that, while in the driveway, Richardson ?verbally accosted? them, ?shout[ing] and curs[ing]? that the women has ??disrespected his house?? by slamming a door.? Richardson then allegedly slammed a fist onto the hood of Jones? car, causing damage in excess of $1,500.

The women claim that, as they tried to leave, Richardson stood behind the car and called for Fatu to come out and ?attack? them.? Fatu then ?opened the driver?s door and began pummeling? Kathleen Hunter ?with her fists.?? Two other unnamed women joined the fray, beating Hunter at the alleged urging of Richardson.

Next, the trio allegedly ?proceeded to beat and pummel Plaintiff Krystal Jones with their fists and feet,? at the direction of Trent Richardson.

Jones and Hunter claim that, after they were able to drive away, they stopped the car, called police, and sought medical attention.

The Browns told the Plain Dealer that they are ?aware of the situation, but will not comment at this time.?

It?s unclear whether the situation was investigated by the authorities for criminal prosecution, and if so whether a decision was made to prosecute, or not.

Arizona driver's license battle heads to court

PHOENIX (AP) ? The first major legal battle over President Barack Obama's policy allowing young illegal immigrants to stay in the United States focuses on whether the federal government or state officials have the authority to decide who is legally in the country.

Arizona Gov. Jan Brewer issued an order in August denying driver's licenses for young immigrants who are protected from deportation and have received work permits under the new policy. U.S. District Judge David Campbell heard arguments Friday in a lawsuit seeking to block Brewer's action.

Immigrant groups argue that Arizona's interpretation of the policy is unconstitutional because the state allows some immigrants with work permits to get driver's licenses, but it won't let immigrants protected by Obama's policy pursue any benefits because the state doesn't consider them legal residents.

"States are prohibited from creating their own immigration classifications, and that is exactly what Arizona is doing here," said Jennifer Chang Newell, a lawyer with the American Civil Liberties Union, in the hearing.

Brewer's lawyers claim Obama's policy isn't federal law and that the state has the authority to distinguish between immigrants with work permits who are on the path toward permanent residency and those benefiting from Obama's Deferred Action for Childhood Arrivals program. The state has asked the court to dismiss the lawsuit.

The state's lawyers argued that Arizona is not violating its own policy by refusing to grant licenses to the immigrants in the deferred action program, because the youths haven't been granted legal protections by Congress.

"They have no hope of lawful status," said Douglas Northup, the lead counsel for the governor and the state Department of Transportation. He noted that Congress had the opportunity to pass immigration reform for young immigrants many times in recent years and choose not to do so.

Campbell said he would issue a ruling within the next few weeks.

Arizona's refusal to view those in the deferred action program as legal residents has become the most visible challenge to Obama's announcement in June that it would protect some young immigrants from deportation. The Department of Homeland Security has said immigrants with work permits issued under the policy are lawfully present in the U.S.

The federal program allows illegal immigrants to apply for a two-year renewable work permit. Qualified applicants must have come to the U.S. before they turned 16, be younger than 30, have been in the country for at least five continuous years, be in school or have graduated from high school or a GED program, or have served in the military.

Arizona's policy allows anyone with lawful immigration status to obtain a driver's license, and more than 500 immigrants with work permits have obtained Arizona driver's licenses in recent years. But Arizona officials have said they don't want to extend driver's licenses to those in the new program because they don't believe the youths will be able to stay in the country legally, a nod to a widely held belief among conservatives in Arizona that a judge will eventually rule the administration's policy unconstitutional.

"The Obama amnesty plan doesn't make them legally here," Brewer said shortly after the program was unveiled.

Her tough stance has been cited by immigrant advocacy groups as evidence that Arizona's refusal to grant the young immigrants driver's licenses is a discriminatory policy that violates the U.S. Constitution's equal protection clause.

Immigrant rights advocates filed their lawsuit in November on behalf of five young-adult immigrants who were brought to the U.S. from Mexico as children. They were granted deferred-deportation protections under the Obama administration's policy but were denied licenses in Arizona.

The three groups leading the lawsuit are the ACLU, the National Immigration Law Center and the Mexican American Legal Defense and Education Fund.

The lawsuit seeks class-action status that would let all other young immigrants in Arizona benefiting from the deferred action program to join the lawsuit. Roughly 80,000 immigrants in Arizona are eligible for the program, according to state estimates.

A similar lawsuit was filed in Michigan after officials there initially decided to deny young immigrants licenses, but the case was dropped when the state changed its policy last month.

At least 38 states have agreed to give driver's licenses to immigrants benefiting from the Obama policy, but Nebraska and Ohio officials have also balked.

Dulce Matuz, president of the Arizona Dream Act Coalition and a plaintiff in the case, said finding a job without a driver's license can be difficult because some online applications and interviewers require a license.

"Gov. Brewer wants to dismiss our human dignity. She wants to dismiss our dreams," Matuz said after the hearing.

'Evolutionary glitch' possible cause of childhood ear infections

Mar. 21, 2013 ? Researchers at King's College London have uncovered how the human ear is formed, giving clues as to why children are susceptible to infections such as glue ear.

The work was funded by the UK Medical Research Council and published today in the journal Science.

It is estimated that one in five children around the age of two will be affected by glue ear, a build-up of fluid in the middle ear chamber. This part of the ear contains three tiny bones that carry sound vibrations from the eardrum to the inner ear. When fluid builds up in the chamber, this prevents the three bones from moving freely so they cannot pass sound vibrations to the inner ear, causing temporary hearing loss. Until now, little was known about why some children appear much more prone than others to developing chronic ear problems, with repeated bouts of glue ear.

Carrying out studies in mice, scientists have discovered the cells that line the middle ear cavity originate from two different tissue types -- 'endoderm' and 'neural crest' cells. The part of the lining that originates from the endoderm is covered in a lawn of cilia (hairs) that help to clear debris from the ear, but the lining derived from neural crest cells do not have cilia. This makes that part of the middle ear less efficient at cleaning itself, leaving it susceptible to infection.

Interestingly, the process of the middle ear transforming into an air-filled space during development appears to be different in birds and reptiles, which have just one little ear bone. Mammals may have evolved this new mechanism for creating an air-filled space to house the additional bones. This indicates that the process of two distinct cell types to create the lining of the middle ear cavity may be linked to the evolution of the three tiny sound-conducting bones.

Dr Abigail Tucker from the Department of Craniofacial Development at King's College London's Dental Institute, said: "Our study has uncovered a new mechanism for how the middle ear develops, identifying a possible reason for why it is prone to infection. The process of neural crest cells making up part of the middle ear appears fundamentally flawed as these cells are not capable of clearing the ear effectively. While this process may have evolved in order to create space in the ear for the three little bones essential for hearing, the same process has left mammals prone to infection -- it's an evolutionary glitch.

"These findings are contrary to everything we thought we knew about the development of the ear -- in all the textbooks it describes that the lining of the middle ear is made of endodermal cells and formed from an extension of another part of the middle ear -- the Eustachian tube. The textbooks will need to be re-written!"

Montana moves to make roadkill legal to eat: Is 'freeganism' a good idea?

It sounds gross, but roadkill salvage is popular in some parts of the US. Montana is fast-tracking ?roadkill salvage? legislation, joining a handful of states where the practice is legal, even encouraged.

By Patrik Jonsson,?Staff Writer / March 21, 2013

Montana is set to license the salvage of roadkill for human consumption, formalizing a practice that is already legal in West Virginia and Illinois, though discouraged in other states, including Texas.

Roadkill salvage and consumption remains a fringe activity, mainly practiced by so-called ?freegans? and other culinary subcultures. In Alaska, however, those who utilize soup kitchens are likely to have had a taste, since fresh roadkill is regularly given to charities. Interestingly, People for the Ethical Treatment of Animals, which opposes most forms of hunting, has pushed states to adopt ?roadkill salvage? legislation so as not to let animals go to waste.

Roadkill salvage has been occurring at least since the 1920s, when animal casualties began to pile up on America's expanding roadways. Many states today take a hands-off approach to the practice. When Tennessee considered a roadkill bill, the proposal was basically laughed out of committee. But Tennessee authorities said no law officer would likely ever charge anybody with ?possession of roadkill with intent to eat.?

The practice also has deep cultural implications, often in the form of negative stereotypes about country folk and rednecks. Yet today, many proponents frame it as a paragon of husbandry ethics that?s tasty and, if carefully inspected, safe.

?If people must eat animal carcasses, roadkill is a superior option to the neatly shrink-wrapped plastic packages of meat in the supermarket,? Vermonter Paul Opel, who has salvaged roadkill for 30 years, told Food Safety News in 2011.

The Montana measure, which passed the state Senate, 33 to 15 vote, Tuesday and will soon head to the governor?s desk, allows law enforcement to issue roadkill salvage permits for elk, deer, antelope, and moose.

To some, the law is part of a growing movement in America toward ?freeganism,? or the consumption of unregulated food ranging from unpasteurized milk to roadkill. Several books have been spawned by the movement, including Sandor Katz?s ?The Revolution Will Not Be Microwaved.?

If the bill is signed by the governor, Montana will join a select number of largely rural states that have formal rules around roadkill salvage. Alaska, for example, uses state troopers to remove the animal, and, if usable, will take it to volunteers who butcher and process the meat so that it can be used by food charities. New York also allows motorists to take home car-struck deer after the motorist is given a tag.

In Wisconsin, 45,000 deer are removed and/or salvaged each year. Nationally, some 1 million animals are roadkilled each day and 1.5 million deer killed by cars each year.

?It really is a sin to waste a good meat,? state Sen. Larry Jent, a Bozeman Democrat, told the Associated Press.

But as the US Congress recently boosted US food inspections after a series of high-profile poisoning cases involving peanuts and spinach, questions are also emerging about the wisdom of licensing roadkill salvage outside of the federal inspection regime.

Sen. Kendall Van Dyk, a Billings Democrat, said police shouldn?t be expected to know how to tell whether a dead animal is safe to eat.

"Despite its good intention, it doesn't pass the smell test for me," Senator Van Dyk said, according to the AP.

Immortality gene mutation identifies brain tumors and other cancers

Tuesday, March 19, 2013

Newly identified mutations in a gene that makes cells immortal appear to play a pivotal role in three of the most common types of brain tumors, as well as cancers of the liver, tongue and urinary tract, according to research led by Duke Cancer Institute.

The finding, published Monday, March 18, 2013, in the journal Proceedings of the National Academy of Sciences, provides a long-sought answer to how some malignant cells are able to proliferate, while normal cells peter out and die.

This key to immortality involves telomeres, the end tabs that protect chromosomes from sticking together or fraying. As normal cells divide, the telomeres gradually grow shorter until they become so short the cell stops dividing and it expires. An enzyme called telomerase serves as a sort of growth factor, temporarily maintaining the length of the telomeres and enabling the cell to continue proliferating.

Scientists have recently learned that mutations of the so-called TERT promoter gene, which controls the instructions for making the telomerase enzyme, is involved in some cancer tumors. It appears that a mutation of the TERT promoter gene essentially creates a constant growth spurt so that the telomeres never shorten, and the cells can divide forever. Earlier this year, the process was described as a leading contributor to melanomas and a small number of other tumors.

The current research expands those findings by analyzing more than 1,200 tumors across 60 different types of cancer. Led by Hai Yan, M.D., PhD, a professor of pathology and investigator with Duke's Preston Robert Tisch Brain Tumor Center, the research team includes collaborators at Johns Hopkins and multiple other institutions.

The researchers found almost no TERT promoter mutations in many major cancer types, including breast and prostate malignancies, suggesting that some yet-unknown factor is causing the telomeres to elongate and promote cell immortality in those diseases.

But the Duke-led research team also identified nine tumor types highly associated with TERT promoter mutations. These cancers generally share a common feature: they arise in tissues with relatively low rates of cell renewal, suggesting they require the mutation to trigger the abnormal telomerase production.

These cancer types include melanomas, liposarcomas, hepatocellular carcinomas, transitional cell carcinomas of the urinary tract, squamous cell carcinomas of the tongue, medulloblastomas, and subtypes of gliomas, including 83 percent of primary glioblastomas, the most common brain tumor in adults with a median survival of only 15 months.

"The results in brain tumors were quite striking," said Patrick J. Killela, co-lead author of the study and a Duke graduate student. "For primary glioblastoma, this is the most frequent genetic mutation yet identified in this tumor."

Four years ago, Yan's laboratory at Duke identified critical gene mutations associated with glioblastoma. But those mutations ? in the IDH1 and IDH2 genes -- were found only in rare glioblastomas that arose from other, lower-grade tumors known as astrocytomas and oligodendrogliomas. The main cancer-causing mutation for the other primary glioblastomas remained elusive.

"Now we see this," said Zachary J. Reitman, Ph.D., an associate in research at Duke and co-lead author of the study. "This is a major discovery in brain tumors, because this single mutation can now distinguish one tumor from another ? and these are tumors that are difficult to classify with a typical pathology test. For primary glioblastoma, the TERT mutation is remarkably common, while for astrocytomas, it is rare. Using both IDH1 and TERT, we can greatly improve diagnosis and prognosis."

Yan said the TERT mutations also provide a biomarker that may be useful for early detection of urinary tract and liver tumors. The finding provides new targets for drug development.

"Cancer is very smart to have figured out a way to use a mechanism to live longer," Yan said. "Now that we know how it operates in these tumor types, we might be able to beat it at its own game."

Acer Aspire M5-581T-6405

Technically speaking, the Acer Aspire M5-581T-6405 is an ultrabook, albeit a rather large one. It uses a low-powered Ivy Bridge Core i5 processor, has a solid-state drive, and is 0.8-inch thick. However, it has a 15.6-inch screen, a rarity among ultrabooks. Performance-wise, it holds its own against similarly configured ultrabooks, and its price is downright reasonable, considering it has a backlit keyboard and a metallic chassis. That said, its lack of touch-screen technology holds it back.

Design and Features
The M5-581T-6405 looks exactly like the Acer Aspire M5-481PT-6644, only bigger. Both sport a brushed metal chassis and both have the requisite Acer logo emblazoned on the lid, which is held in place by a pair of strong, durable hinges. The M5-581T measures 14.4-by-10.1-by-0.8 inches (WDH) and weighs 5 pounds, making it one of the bulkier ultrabooks around, especially when compared to models such at the Toshiba Portege Z935-P300 and the Acer Aspire S7-391-9886. Still, it's not a backbreaker and is certainly thin enough to slide into a crowed backpack. The metal chassis stays cool and has a nice sturdy feel.

The full sized chiclet-style keyboard offers plenty of room for comfortable typing, and the keys are well spaced. The dedicated number pad is a plus, but those keys are a bit skinny. As with the Acer M5-481PT-6644, the keyboard deck is metal-clad and the entire keyboard is backlit. The one-piece touchpad is wide, offering plenty of room for pinching, zooming, swiping in Charms, and other Windows 8 gestures.

The M5-581T has a 15.6-inch display that maxes out at 1,366-by-768, a relatively low resolution for a screen of this size. Although it can't display HD content in 1080p it does do a good job of displaying 720p video and delivers a bright picture with vibrant color reproduction. Alas, the screen is not touch-enabled, so you'll have to navigate Windows 8 via the touchpad and keyboard.

Port selection is standard ultrabook issue. There are two USB 3.0 ports and one USB 2.0 port on the back of the M5 along with a LAN jack and an HDMI port. You don't get a VGA (analog) port on this model, though. The left side is home to a tray loading DVD multi-drive and the right side holds an SD/MMC card reader slot and a headphone jack. A webcam and microphone are built in to the display's upper bezel and there are two small Dolby powered speakers embedded in the base that are loud and relatively full sounding, although they could use more bottom. In addition to the gigabit LAN port the M5-581T has 802.11b/g/n and Bluetooth 4.0 networking capabilities.

The M5-581T is outfitted with a 20GB solid-state drive and a 500GB, 5,400rpm hard drive. In addition to Windows 8, you get Acer Cloud, webcam, and backup utilities, Skype, and a handful of trial (bloatware) apps such as ebay, Amazon, HuluPlus, Netflix, and MS Office. Acer covers the M5-581T with a one-year warranty.

Performance
Acer Aspire M5-581T-6405 A 1.8GHz Core i5-3337U processor and 6GB of system RAM give the M5-581T plenty of productivity power. Its PCMark 7 score of 3,241eclipsed that of the Asus VivoBook S400CA-UH51 (3013) but trailed the Acer M5-481PT-6644 (4,016), the Vizio 14-inch Thin + Light (C14-A4) (4819), and the Asus Zenbook Prime Touch UX31A-BHI5T (4510).

However, it outscored all of the above-mentioned ultrabooks on our Cinebench R11.5 CPU test, if only by a hair. It also turned in the quickest Handbrake encoding time (1 minute and 25 seconds) but needed 7 minutes and 13 seconds to complete the Photoshop CS6 workload. That's the slowest time of the bunch, with the exception of the Acer M5-481PT-6644 (7:18).

When it comes to playing video and running low- to mid-range games the M5-581T's Intel HD Graphics 4000 solution will get the job done, but it lacks the horsepower to run complex graphics-intensive games that require at least 30 fps (frames per second) to play smoothly. It managed only 11 fps on our medium quality Aliens vs. Predator test and just 7 fps on the high-quality setting. That's pretty much in line with other ultrabooks that use the integrated Intel GPU. Results were similar on our Heaven benchmark test where the M5 turned out 12 fps (medium quality) and 6 fps (high quality).

Acer Aspire M5-581T-6405

The M5-581T gave us 6 hours and 17 minutes of juice on our Battery Rundown test, which is outstanding considering it uses a 15.6-inch display. It outlasted the Acer M5-481PT-6644 (6:04), the Asus Vivobook (4:18), and the Vizio 14-inch Thin + Light (4:30) but couldn't quite keep up with the Acer Iconia W700-6465 (6:34).

With its sleek, sturdy chassis, Core i5 power, and affordable price tag, the Acer Aspire M5-581T-6405 is a good choice for users looking to enter the Windows 8 ultrabook arena without spending a fortune. Granted, it's larger than most of its competitors, but it's still very portable and you get a bright 15.6-inch screen in return. Touch-screen technology would make this a Windows 8 ultrabook to be reckoned with, however. If you have some wiggle room in your budget, consider the Acer Aspire M5-481PT-6644, our Editors' Choice for entry level touch-screen ultrabooks. It offers ten-point touch display technology, solid performance, and a 14-inch all-metal chassis for around $130 more.

Samsung Galaxy S 4 crushes iPhone 5, other leading phones in early performance tests

You can blame CNN all you want for its reporters feeling sorry for the now convicted rapists in the ongoing case in Steubenville, Ohio, but MSNBC, Fox News, and?CNN all just outed a 16-year-rape victim to millions. Seeking to report on an emotional case for all that it's worth, apparently, all three networks ran this unedited clip from the courtroom video feed, in which one of the defendants responds to Sunday's verdict by apologizing to the Jane Doe victim by name:

Downhill skiing is the club?s primary focus and it was formed to get better deals on lift tickets and lodging for our members. During the winter, when conditions allow, we schedule cross country ski and snowshoe days in the area every weekend.

The EISC tries to go on two major ski trips out West, as well as two or three Midwest trips each year.

This ski past season, the club spent seven days in Breckenridge, Colo., and we recently returned from a seven-day trip to Jackson Hole, Wyo.

Each trip had about 28 club members in attendance. We were fortunate enough to have new snow and great skiing conditions on both.

The club does a ?learn to ski? day every year at Sundown Mountain in Dubuque in late December, where we try to introduce people to the sport. It has been very successful.

In mid-January, the club spent a weekend in Minneapolis where our members skied Wild Mountain ski resort one day and Welsh Village ski resort the next.

Several members opted to go downtown or to the Mall of America as an alternative.

Besides skiing, the club likes to get together for EISC nights at area sporting events. We have a night at the RoughRiders this month, will attend a Titans game in May and the Kernels in June.

Many of our members also are avid bicyclists and we have rides throughout the summer. We enjoy the Cedar River Trail almost weekly and have trips planned to ride in the Cedar Falls/Waterloo area and the Heritage trail in Dubuque.

In August, the club has a weekend trip planned to ride the Gandy Dancer Trail in the St. Croix Valley, while other members will make this a kayak/canoe trip on the St. Croix River.

Some of the club?s other activities include the annual EISC Golf Outing and we usually do a EISC wine tasting night.

Over the years, ski club members have enjoyed some of the best ski resorts in the United States. In 2010, the club had a ski/sightseeing trip to Austria and Switzerland. We were able to ski San Moritz, Kitzbuel and the Stubai Glacier on the same trip. Last year we spent a week at Beaver Creek, Colo., with a day trip to Vail and did a train trip in late February to Winter Park.

The club always is ready to welcome new members.
